‘Parents & Their Children’s Right to Privacy’

INTRODUCTION:

 

You have just received a phone call from your friend, ‘Johnny’.  Your parents do not like Johnny, because they feel that he is a ‘bad influence’.  Your mom decides to eavesdrop on your conversation by pressing the conference call feature on the base of the phone.  She overhears Johnny bragging to you about a crime he has just committed.  Your parents are furious and call the police.  Johnny is picked up and eventually arrested for the computer.

 

Believe it or not this scenario is based on an actual case that has gone all the way to The Supreme Court. 

 

Below is a short history of ‘The Right to Privacy in America’:

 

The Right to privacy was established in 1789 with the writing of the Constitution. The British had violated the colonialist’s rights by using Writs of Assistance to gain entrance into homes without a search warrant.  For the next 200 years, this right has been a cornerstone of American democracy.” However the question arises; is the right to privacy unlimited? You will have to decide that in this web quest.  YOU have been selected as an adviser to the court hearing Johnny’s case. You will have to make a presentation to them so they can decide the case. Your role as adviser is critical. The findings of the Court will set a precedent for all who follow.

TASK:

 

Your task is to investigate the issue of ‘a person’s right to privacy’ under the Constitution and the Bill of Rights, specifically the Fourth Amendment.  You will decide whether you feel if the parent’s in this case have violated the child’s right to privacy.  Using the CONLAW worksheets on the TIPS website, you will fill  in the required information.  You will then write an argument to try and persuade people to agree with your point of view.  We will then hold a class debate on this topic of ‘Parent’s & Their Children’s Right to Privacy’.

 

Once you have done your research, you will work with a partner to give your presentation.  You have a choice of as to how to present your final product.  You may choose to do a poster board or a PowerPoint format.

 

 

THE PROCESS:  

 

1.      Complete the TIPS worksheets.  You will then use this information to help you in your debate.

a.     What is the problem?

b.     Where is the evidence?

c.     What are the causes?

d.     What is the existing policy?

e.     What policies can you create to correct the problem?

f.     What is the best policy to correct the problem?

2.     Use the ACLU website and describe in your own words what you feel their function is.

3.     As a class, we will read the attached article: “On The Law”:  

4.       Refer back to your worksheet and answer the question pertaining to the article.

5.     You are to choose a side to debate. You can select either the parent’s point of view or the child’s point of view.

THE CONCLUSION:

 

After you have completed the worksheet, ask yourself:

“Do you feel that under the law, ‘Johnny’s’ right to privacy was violated?”

                        OR

“Do you feel that the parent’s should have the right to monitor their child’s friends?”

 

By completing this Webquest, you have learned about some of the rights guaranteed to every citizen under ‘The Constitution’.
