Due Process in the Democratic Society

 

 

 

 

 

INTRODUCTION:

In one earlier Supreme Court decision ( Powell v Alabama, 287 US 45) it was ruled that the right to counsel was essential in safeguarding freedom but the extent of the right was left to the discretion of the states. In a prior case (Betts v. Brady, 316 US 455), the Court ruled that the presence of legal counsel depended on the nature of the case. Although this precedent did not change over the next two decades, the issue of right to counsel persisted to be a problem.

Who was to pay the legal fees for those who were indigent? Was legal counsel a right or a privilege? Was denial of counsel due to one’s economic status a constitutional violation?

These questions had to be addressed, and were subsequently addressed by the Warren Court in the second half of the twentieth century.

YOUR ROLE

You are now Mr. Gideon. You have been arrested and convicted of a felony crime, but you do not have enough money to afford a lawyer. Your task is to defend your right to get a lawyer. The judge has denied you this right.

No state shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any state deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.                     

 

                     Amendment VI

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.
