INTRODUCTION

 

STUDENTS’ RIGHTS

 
YOUR STUDENT COMES INTO THE CLASS 20 MINUTES LATE AND STATES:
 
“The dean stopped me in the hallway and searched my book bag.  He stated he saw an object protruding out of the book bag, which resembles the handle of a gun.  After searching the book bag, he realized it was an umbrella. This was humiliating and embarrassing because following the rules of the school is something that I believe in doing.  The other students were looking at me as if I did something wrong."

 

Do the school personnel have the right to search the book bags of students?  Do you have to submit to a search?  What amendment protects you from such actions?

TASKS

 

Students will take a position and decide whether they agree or disagree with the actions of the school personnel:

 

&   Students will use the CompuLEGAL to find (2) precedents (court cases) to support their opinions.

 

&   Students will use Microsoft PowerPoint to present a visual presentation.

 

&   Students will review the contents of the Fourth Amendment:

 

Amendment IV

 

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

 

PROCESS

 

ü       Students will be divided into two groups. One group agrees with the actions of the school personnel and the other group disagrees. http://www.maxwell.syr.edu/plegal/scales/tlo.html

ü       Each group will have Facilitators, Recorders and Presenters.

ü       Each group will prepare and discuss their decision and prepare a written report plus a PowerPoint presentation to present to the class.

ü       Students will use CompuLEGAL to obtain information that supports their view to write a report.

ü     Students will create a PowerPoint presentation with no less than six slides.

ü       Students will use Ask a Legal Eagle to ask any questions related to search and seizure cases.
