The U.S. Supreme Court in a 5-4 decision, ruled that the Seattle school district's "student assignment plans are not narrowly tailored to achieve the compelling goal of diversity properly defined." The Court said that "Although remedying the effects of past intentional discrimination is a compelling interest under the strict scrutiny test, ... that interest is not involved here because the Seattle schools were never segregated by law nor subject to court-ordered desegregation."
