The Court should rule in favor of the Parents Involved because their children were being denied the choice of schools to go to because of the use of race in helping to determine the diversity in the Seattle schools even though there was no desegregation plan which the school district was forced to institute.
Argument #2
The Court should rule in favor of the school district. There is a compelling interest for the school district to create diversity in their schools. Plans to integrate schools so that diversity may be achieved are still necessary and useful to overcome problems of cities divided by race and poverty.
