The Facts of Owasso School District v. Falvo:
 In 1998 in a Middle School in Oklahoma, the teacher gives a quiz to her class. Afterwards she has the students exchange their quiz with the student sitting next to them. After having the students grade the quiz, she calls out each student's name and records their score. One of the students in her class, Phillip Falvo, is a Special Ed. student who does not do well on quizzes. He is embarrassed that his score is read aloud so that all the other students know his grade. He complains to his mother and his mother hires an attorney.
