The Facts of McCleskey v. Kemp:
Warren McCleskey a black man was convicted of murdering a white police officer while committing a robbery. He was sentenced to death. He appealed, citing a study that defendants charged with killing whites were 4.3 times as likely to receive the death sentence as defendants charged with killing blacks and that black defendants were 1.1 times as likely to receive the death sentence as other defendants.
