The Facts of Mapp v. Ohio:
In May of 1957 the Cleveland police received a tip that a bomber was hiding out
at the home of Miss Mapp. After claiming to have a search warrant the police
arrived at Mapp's house and forcibly entered. Mapp after demanding to see the
search warrant, struggled with an officer and was subsequently placed in
handcuffs and her hosue was searched. During the search, the police found
obscene materials and Mapp was arrested for possession of these. Mapp's lawyer
argued that no search warrant was produced by the police before searching Mapp's
home. Since they found the obscene materials without a warrant, that material
should not be used in court against Mapp.
