Schenck should not be convicted for conspiring to violate the Espionage Act.  He never explicitly advocated for people to take illegal actions.  There also was no clear and present danger.  Schenck has a right to make his opinions known to others.

The country was at war, therefore Congress had the right to prevent acts which it deemed necessary to protect national security interests.
