Webster v. Reproductive Health Services:The Precedents


Here are a list of precedents for the case.

Akron v. Akron Center for Reproductive Health (1983): A State may not adopt one theory of when life begins to justify its regulation of abortions.

Roe v. Wade (1973): The Court has emphasized that it implies no limitation on a State's authority to make a value judgment favoring childbirth over abortion.

Maher v. Roe (1977): The Court ruled that a state could constitutionally refuse to give Medicaid financing for non-therapeutic abortions, even though it gave Medicaid financing for the expenses of ordinary childbirth.

Griswold v. Connecticut (1965): The Court recognizes a general right to privacy.

DeShaney v. Winnebago County (1989): The Due Process Clauses generally confer no affirmative right to government aid.

Poeller v. Doe (1977): A city committed no constitutional violation in electing as a policy choice, to provide publicly financed hospital services for childbirth without providing corresponding services for therapeutic abortions.

Harris v. McRae (1980): The Court upheld the Hyde Amendment which withheld from States federal funds under the Medicaid programs to reimburse the costs of abortions, except where the life of the mother would be endangered.
