United States v. Virginia: Arguments

Argument #1

The Court should side with the State of Virginia in this case. The State has an interest in promoting a diversity of educational opportunities for its citizens. One of these opportunites is a single sex military academy for boys. There exists a long tradition of support for the Virginia Military Academy. Girls who wish to attend a military academy may attend a program run by VMI but set up at a nearby school.


Argument #2

The Court should rule in favor of the U.S. in this case. Since VMI is a state funded school, it cannot discriminate against people because of their gender. Therefore, VMI should be forced to open their school to females who wish to attend and receive their education there.
