Schenck v. U.S. : Arguments

Argument #1: Schenck should not be convicted for conspiring to violate the Espionage Act. He never explicitly advocated for people to take illegal actions. There also was no imminent threat to national security. Schenck has a right to make his opinions known to others.
 

Argument #2: This country is at war, therefore Congress has the right to prevent acts which it deems necessary to protect national security interests.
