The Court should rule in favor of Johnson in this case. Johnson outscored Joyce in the interview portion of the test and he has worked at the agency three years longer than her. To promote Joyce over Johnson is to discriminate against Johnson because he's a male.
Argument #2
The Court should rule in favor of the county (Santa Clara). There was past discrimination against women at the county. Also women are currently underrepresented in higher level jobs. The county wanted to remedy this situation, so they promoted Joyce (a woman) rather than Johnson (a man). Both Joyce and Johnson were qualified for the job.
