New York v. Quarles: Facts

Following a rape complaint and after chasing the accused into a supermarket the police apprehended Quarles and discovered he was wearing a holster for a gun. the police officer asked him where the gun was and the accused said "the gun is over there." The officer retrieved the gun, placed the accused under arrest and read him his Miranda rights. The accused's statement about where the gun was and the gun itself were excluded by the trial judge since the statement was made prior to having his Miranda rights read to him.
