Planned Parenthood v. Casey: Decision

The Supreme Court in a 5-4 vote upheld the essence of Roe v. Wade, but ruled that the state may impose some restrictions on abortions. Part 3 (a married woman is required to sign a statement indicating that she notified her husband of her intended abortion) was ruled unconstitutional. The Supreme Court did not strike down Roe v. Wade but did recognize the right of states to place some restrictions on this right such as parental notification (Part 2) and waiting periods (Part 1). "The woman's right to terminate her pregnancy before viability is the most central principle of Roe v. Wade. It is a rule of law and a component of liberty we cannot renounce...it does not at all follow that the state is prohibited from taking steps to ensure that this choice is thoughtful and informed...Only where state regulation imposes an undue burden on a woman's ability to make this decision does the power of the state reach into the heart of the liberty protected by the Due Process Clause."
