Church of Lukumi Babalu Aye v. Hialeah: Arguments

Argument #1

The Court should rule in favor of the city of Hialeah. The government has a compelling interest in banning animal sacrifices. The community dislikes the practice of animal sacrifices.

Argument #2

The Court must rule in favor of the Santerian Church. This ordinance was passed specifically to prohibit the Santerians from conducting this specific act which is part of their religious practice. The Free Exercise Clause of the First Amendment prohibits the government from enacting laws which prohibit the free exercise of religion.
