A police officer overheard what he thought to be a drug deal over a
public telephone. Following the suspect, the officer pulled him over after
observing him commit a traffic violation. The officer told the man that he had reason to
suspect he was carrying narcotics in the car and asked permission to
search the car. The suspect agreed. During the search the officer found a paper bag which he
opened to reveal cocaine. Charged with possession with intent to
distribute cocaine. In trial court, the suspect moved to suppress the cocaine on the ground
that his consent to a search did not extend to the bag. The trial court
agreed. Both the District Court of Appeals and the Florida Supreme Court upheld the trial
court.
