Gideon v. Wainwright: Arguments

Argument #1
  The Court should rule in favor of the State (Wainwright). The Sixth Amendment does not apply to non-capital offenses. Therefore, Gideon should not be appointed a lawyer by the court.
 

Argument #2
  The Court should rule for Gideon. Just because he cannot afford an attorney, he should not be forced to defend himself. There should not be a distinction between the type of crimes a person is charged with.
