1) the ordinance as implemented violated the free speech guarantees of the First and Fourteenth Amendments because: a)they were so narrowly drawn, and b)the fee would depend on the administrator's assessment of the amount of hostility likely to be created by the group; 2)given such constitutional violations neither the $1,000 fee or even some lower nominal amount would be acceptable.
