Owasso v. Falvo : Arguments

Argument #1
  The Court should rule in favor of the Owasso School District. FERPA only applies to a student's final records. Teachers can use educational techniques like having students grade each other's assignments or having students solve problems on the blackboard. These have been used for decades by teachers and the federal government has no business telling a teacher what methods he or she can or cannot use.
 

Argument #2
  The Supreme Court should rule in favor of Falvo. Having students know other students' grades is wrong and a violation of FERPA. Just as a student is not allowed to ask a teacher what grade another student received, so should they be unable to know how that other student fared on an in class quiz. The teacher should collect all the quizzes herself and grade and record them without any student knowing the score of any other student.
