Escobedo v. Illinois: Arguments

Argument #1
  The Court should rule in favor of the State of Illinois. Escobedo's confession was obtained voluntarily. He made a statement to police while under their custody. No physical violence was used by the police to obtain the statement from Escobedo.
 

Argument #2
  The Court should rule for Escobedo. He was not allowed to have his attorney present with him during the interrogation even though he repeatedly asked for his attorney. By denying his requests for counsel, the police violated Escobedo's Sixth Amendment right and any statements made should be inadmissible in court.
