Minnesota v. Dickerson: Arguments

Argument #1

The Court should rule in Dickerson's favor. The police officer was only permitted to search Dickerson for weapons. When the package in Dickerson's pocket was felt, the police officer knew it wasn't a weapon but still continued to manipulate it until he was convinced that it was drugs. Therefore anything besides weapons found on Dickerson should be inmadmissible as evidence against him.


Argument #2

The Court should rule in favor of the state of Minnesota. The police officer found the drugs on Dickerson during a valid patdown search for weapons. The drugs can be used as evidence in court.
