Chabad Lubavitch v. Burlington: Arguments

Argument #1

The Court should rule in favor of the City of Burlington. The menorah is clearly a religiou symbol, and by allowing it to be placed in a public park would be in violation of the Establishment Clause of the First Amendment.

Argument #2

The Court should rule in favor of Chabad Lubavitch. The display is part of a secular display and would not be associated with the government in any way.
